The Preparatory Committee of the UPC has issued an opinion on 29 January 2014 that, in their view, any European patent that has been opted out of the UPC is no longer subject to any of the provisions thereof. Instead, it is their view that the national law of the contracting state in which any action were brought, would need to be applied.
